The rules for using Slap It.

The short version. Leave stickers, be decent about it, don't get hurt looking at your phone. Anything you leave is public. We'll take down content that's abusive and remove the people who post it. This is a beta, so expect rough edges and don't rely on it for anything that matters.
These terms are an agreement between you and Happy Path ("we", "us") about the Slap It app and this website. Using the app means you accept them. If you don't, don't use it.
You need to be 13 or older to use Slap It.
Slap It is unfinished software handed out for testing. It will have bugs. Stickers may fail to come back, spots may be lost, and we may reset data between builds. Features can change or disappear. We may end the beta, or shut down a build, whenever we need to. Don't put anything in Slap It that you'd be upset to lose.
The app signs you in anonymously the first time you open it, and you can link an account later with Apple or an email address. Keep your sign-in details to yourself. Anything done with your account is treated as done by you. Tell us if you think someone else is in it.
You keep ownership of the stickers you make. By saving one, you give us permission to store it, and to show it to other people using Slap It, along with the spot's photo thumbnail and its location. That permission lasts as long as the sticker is up, and ends when you delete it or delete your account. We don't use your stickers for advertising and we don't license them to anyone else.
You're responsible for what you leave. By saving a sticker you're confirming it's yours to post, and that it doesn't break the rules below.
Slap It is a public wall in a real place. Don't leave anything that is:
There is no tolerance for objectionable content or abusive users. We remove content that breaks these rules and we remove the accounts behind it, without warning where it's warranted.
Placing a sticker means standing somewhere in the real world with your phone up, and that's on you:
Virtual stickers don't mark or damage anything. Nothing about this app is an invitation to put real paint, paper or adhesive on anyone's property.
Press and hold on any sticker that isn't yours to report it. Reports reach us directly. We review reports and act on them within 24 hours, which usually means deleting the sticker, and removing the account if the person meant it.

We can remove any content and suspend or delete any account, at our discretion, to keep the app safe. We don't promise to review everything that gets posted, and we're not responsible for what other people leave.
You can leave at any time: Profile → Delete Account, which removes your content along with the account. We can suspend or end your access if you break these terms, or if we stop running the service. The parts of these terms that should outlive the account do: ownership, disclaimers, liability.
Your licence. We grant you a personal, non-transferable licence to use Slap It on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, with the exception that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. Nothing here grants you rights in the app itself beyond that licence.
No warranty. Slap It is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will work uninterrupted, that stickers will be found again, or that your data will be preserved. We are solely responsible for any warranty that can't be disclaimed. If the app fails to conform to one, you may tell Apple, and Apple will refund what you paid for it, which is nothing, because Slap It is free. Beyond that refund Apple has no warranty obligation of any kind, and any claims, losses, costs or damages arising from a failure to conform are ours to answer for, not Apple's.
Limitation of liability. To the fullest extent the law allows, Happy Path is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits, or personal injury arising from your use of the app. Our total liability for any claim relating to Slap It is limited to the greater of the amount you paid us for it (which, during the beta, is nothing) or 50 USD.
Indemnity. You agree to cover us for claims brought by someone else arising from what you left in the app or how you used it.
Apple. These terms are between you and Happy Path, not Apple. Apple has no obligation to provide any support or maintenance for Slap It. Apple is not responsible for the app, for any claim that the app fails to conform to a legal or regulatory requirement, or for any third-party claim that the app infringes intellectual property rights. Handling those is ours. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
Other people's terms. Using Slap It doesn't excuse you from any other agreement you're under. Where third party terms apply to how you use the app, whether your mobile carrier's, your employer's, or the rules of a place you're standing in, you have to comply with those too.
Governing law. These terms are governed by the laws of the State of California, without regard to conflict of laws rules, and any dispute will be brought in the state or federal courts located in California.
Changes. We may update these terms; the date at the top will change and significant changes will be flagged in the app. Continuing to use Slap It after a change means you accept it.
Everything else. If any part of these terms is unenforceable, the rest still stands. These terms, plus the privacy policy, are the whole agreement between us about Slap It.
